TFA Neutral on this bill except to the extent that it may create another "class" of civilians who are being granted special carry privileges based on their job.  TFA routinely opposes all bills which propose to give civilians (anyone who is "off duty" under Tennessee law) special privileges to carry firearms based on what their normal job may be.

TFA SUPPORTS restaurant carry legislation but OPPOSES the portions of this bill that are in the proposed amendment which contain the "age restricted" and "curfew" (11pm cutoff) provisions.  The bill needs to come out without these restrictions such as the Senate has passed in the last 3 years.  It is possible that these provisions could be removed in a conference committee but let's either strip them now OR run a clean bill such as the Firearms Owners Protection Act of 2009.  There are approximately 10 restaurant bills but this is the 1st one moving.

CRIMINAL LAW: Handgun carry permit holders to carry in parks. Authorizes people with handgun carry permits to possess firearms in parks owned by state, local, or federal governments. AMENDMENT: House Judiciary Criminal Practice Subcommittee Amendment 1 deletes state parks from the bill's provisions. The amendment also makes it permissive for a local government to allow firearms to be possessed in local parks. A majority vote of the local governing body would be required. Local governments would be able to decide in which local parks or specific areas of local parks, firearm possession would be allowed. (SENATE: SB 1518, Burchett; Referred to Senate Judiciary.) FISCAL NOTE: Dated: February 23, 2009 Minimal

TFA supports parks carry.  However, this is another situation where the issues of federal, state and local parks are being handled in separate bills which poses the risk of creating gaps in the legislation for places such as "greenways".  TFA also opposes exempting local parks because some of these are quite large.  A compromise may be to allow local legislative bodies (not parks administrators) to pass ordinances banning firearms possession within a certain distance (e.g. 100 yards) of any established ball diamond or field (football, soccer, etc.) and requiring that such locations be both clearly posted and that the restriction only apply when the sporting facilities are in active use.  This proposed compromise IS NOT what is contained in the pending amendment.

Current law allows law enforcement officer to carry firearms at all times, on-duty or off-duty, except if prohibited by federal law, court orders, or written directives of the executive supervisor of the employing agency, or if the officer is on school grounds or under the influence of alcohol or a controlled substance. AMENDMENT: House Judiciary Criminal Practice Subcommittee amendment 1 requires current and retired judges to undergo the same training for carrying a firearm as that of law enforcement officers. TFA SUPPORTS bill but it is getting opposition from the "open records" supporters.  We are considering proposing an amendment that would allow access to the records if the requesting party is required to sign a statement under penalty of perjury (a misdemeanor) that the use of the database would not allow publication of personal information, including names, street addresses, etc., of anyone in the database in any publicly accessible means such as internet sites, newspapers, etc.  It would also be advisable to allow civil actions for enforcement of this right which allow recovery of actual damages, statutory damages (e.g., $500 per violation ) and attorney's fees.

TFA SUPPORTS this bill but it should also allow possession by students who are of the appropriate age.  Many students who are 21+ are commuters and the concerns that they have for their safety are equal to the concerns of the faculty.

This request came in from TFA member David Borum who is involved in OHV issues.  TFA also tracks these OHV related issues because they can have a direct impact on many gun owners/hunters.

Today I again visited my congressman's (Duncan) office on the issue of the Tellico OHV area and the Forest Service "preferred" alternative for closure of the area.  He is willing to help and I also asked that he contact Rep. Heath Schular's office in North Carolina on the issue. 
 
They told me they are getting almost zero calls from people that are upset about the proposed closure and would like to get more.
 
This is not good.  I need EACH one of you to call Congressman Duncan's office and Congressman Schulars office to tell them you oppose the forest service preferred alternative to Close the area permanently because of "junk science" and you want the forest service to follow "Caliber Engineering's" independent non-bias study and suggestion to fix the area to keep the area open.  Let them know that congressman Duncans Maryville office has the study and it can also be found here:
www.sfwda.org/trails/tellico/study09   Also remind them we only have around 20 more days to respond to the Forest Service's request for input.
 
PLEASE DO THIS TODAY so they can put pressure on the FS to do the correct thing.  If you have called before do it again.  If you are not in their district call them anyway and tell them how it will economically impact their areas and then call your personal Rep and tell them to work with Duncan and Schular to keep the area open.

TFALAC ALERTS - mailing list maintenance

TFA is now using a mailing list software product for the TFALAC alerts which allows more flexibility and which automatically helps to maintain the mailing list.  As part of that conversion, the software automatically tests each email address to see if it is valid.  Apparently, some email addresses (notably AOL, Comcast and other large ISP's) are now blocking tests to verify the existence of accounts and consequently some addresses are being purged that are valid accounts.

Once I know that an address is subject to this problem, I can flag it as valid so that the purging process will skip over it.  However, I need feedback from individuals to alert me to this problem. 

Therefore, I am asking everyone who receives this email alert to forward it to others in your gun clubs, shooting/hunting networks and anyone who you think may be interested in TFA or these free alerts.  I want to try and make sure that everyone who wants these alerts is receiving them. 

If you receive this alert as a forward and you want to subscribe to it, you will need to send a subscription request through this link:
