CLIFF NOTES AT BOTTOM
I will try to make this short as possible.

I am parting out a Jeep Cherokee.  I had several inquires about the wheels and tires but I didn't want to get rid of them because I needed rollers to get it to the scrap yard after I was done.

I finally decided that I would sell them for $200 + 2 rollers in return.  A member here called me and asked if I would take $150+ 4 good factory alloy wheels and tires in return.  He also stated that it would take him a couple of days to get his wheels and tires back to me, as they were on his jeep.  I agreed.

I made several attempts to get him to bring them to me over the next week, with no luck.  10 days after he got them, I had to come to Huntsville for work.  I offered to pick them up from him while I was in town, so he wouldnt have to drive all the way back to my place with them.  He said that sounds great.  I get done with what I have to do and text him saying I can meet him, to which he says he forgot them and would bring them to me tomorrow. 

Another week or so goes by with no contact from him.  I had called and PMd him here with no response.  He finally sent me a PM back saying that turns out he has a small heart condition and he was in the hospital a few days, but he would def bring them in the next day or so.  Again, I said ok.

5 days ago, I offered to meet him in Guntersville to get them.  Again, he said that he was bringing them tomorrow (which would be the 6th).  Never showed.

I have called, texted, and PMd him (he has been online a few times since I pm'd him) with no response.   I really hate posting something like this but feel I don't have another choice. 

I am not gonna say who it is YET, want to give him a chance to make it right first.  Anyone have any opinions on this?  What should I do?

Multiple lies by buyer about bringing wheels/tires
Been over a month, no response from buyer.
Buyer is a member on the board.

If you ain't going to say who it is, you at least need to post up who it ain't; like the 3 dudes who asked about your tires/wheels in your for sale ad thread.
 
If the guy doesn't respond in 24 hours, post it all up on Pirate complete with name, address and phone number.  They love this kind of stuff on there.

Im sure the guy isnt active duty , so his superiors prob dont care. If it were me Id just figure out where he lives and go over there with a floor jack and a 4 way and either get my wheels back or find the rollers. Leave his money minus 50 bucks for your trouble in his mailbox.

From what I was told by a member that passes his apartment everyday, he pulled the tires I sold him off of the wheels I sold him and mounted them on some black steel wheels that I believe he bought from someone here too.. No real way to get my combo back

I think its time for ibrokeit (cool screen name) to call the police and file a complaint.  Posting up here is not accomplishing much of anything, and we are starting to sound like a lynch mob.  I am certainly not defending the other guy's actions, but this is all just ranting and venting unless a legal complaint is filed with LEO.
 
If you want something done about this, I suggest you call the cops and ask for their help.

Hmmm - I dont think this is true.  Call the police non-emergency number (Hsv police 722-7100) and report a theft of property.  They have no choice but to investigate a reported crime.

As far as this guy being a Marine because of his handle?  Seems like there's a guy that floats around here that calls himself "Marine" that never saw a day in uniform.

Don't think just because you call HPD they will respond. I personally called them when a friend of mine's car was broken into and a bunch of my stuff was stolen. We knew who did it and had even seen some of our stolen stuff but HPD told me the northside precent was closed at 4PM and they refused to respond.

Well someone here knows what apartments he lives in.  As soon as he lets me know, I will give them a shot.  I don't have much faith that it is going to do any good, esp considering I only know his first name and what he drives.  I don't even know what unit number he is in.

I am off work tomorrow.

I just sent him a text message and a PM letting him know that if the wheels and tires aren't here in the morning, I am going to be driving up to Decatur to file the report in person.  I guess I will just wait and see what happens.

Honestly, I don't care if he wants to say that or not.  All I want is for the wheels and tires to be here.  This has gone on too long, and even after a month of waiting, I still will take the wheels and tires and be done with it.  No grudges, just want him to make things right.  We will see what happens tomorrow.

Yeh, HPD will come investigate........and then arrest him for filling a false police report.  Nothing was stolen.  This is strickly a civil dispute at this point.  He could go to small claims, but he would loose there unless he has a written/signed contract.  Even if he wins in small claims; it's still up to him to colect.  Bottom line, unless the dude decides to provide the wheels or compensation, he is SOL.

PMs and posts.  I believe there are precedents that documents such as these, held as they are by a disinterested third party, would constitute a contract.

Someone has been watching too much TV court drama.


A verbal contract is still a contract, it is just harder to enforce.  Text messages and PM's make it clear that returning the wheels/tires was part of the consideration of the contract, so it's not even that hard for a Judge to figure out what happened.

The buyer would literally have to go to court and lie to the judge at this point, saying the tires/wheels were not part of the agreement, even though his own texts state he intends to return them.

WELL....

He was supposed to bring them thurday, right?  I texted him Thursday around noon and asked if we are still on for this afternoon.  He said yes.  About 30 minutes later, he asked how much I wanted for everything I had left.  I gave him a price and he said that he wanted it.  Told me he would come get it all the next day.  I was going out of town friday and not coming back in till monday morning, so like the retard that I am, I told him to be here monday at 6.

Monday rolls around.  At 6:30, he isn't here so I call him.  Told me he is waiting on his buddy to get there with his trailer and he will be on his way.  I let him know that I have to go back out of town but someone whould be there to collect the money.  He says ok.

Right after I posted "for those who want an update...." this morning, he texted me.

"My buddy loaned my trailer out and it cant be found.  I did a police report.  But if i have to by this weekend i will rent a uhaul or something and come get it"

What size tires and rims do you need, I have some I will give you if they will fit.  I have a full set of 5 on 5.5, but considering you are parting out an XJ I would assume 5 on 4.5.  Either way if you find some rims I have the tires.

 If you know where the guy lives. Go get a tag number off of his jeep,then go to the Decatur Police and see if you can get them to run the tag Number. The Dude's Daddy or Mom might own the Jeep and you might could trace that person down and tell them your story. Bear in mind the parents might be losers to and this might not help you at all.
