Roger Theurer the SFWDA President attended the mediation meeting here is his report.

We met with a mediator and the USFS (Marisue Hilliard and lawyer) at Charlotte, NC. The FS's initial offer was the same BS we heard before, drop the lawsuit and we will help you work with the state of NC and try to find a new area. We suggested rebuilding the trails at Tellico to meet current standards of engineering etc., Marisue's response was they will not even consider reopening Tellico. We proposed adding full size trails to the Roy A. Taylor ATV area (the area is about 40,000 acres), they replied that they are in the process of closing that area.
We left the meeting with the proposal that we would submit a list of potential sites for a new or improved OHV areas, when they reject these we will continue on with the lawsuit.
The FS did exactly what I expected at the meeting and yes it probably was a waste of time, but we have now checked off one more step in the legal process.

Waste of money and time-Southern doesn't have deep enough pockets to make it a fair fight. Southern needs to buy a large track of land with their membership paying the note. They could lease out the park to events and charge the public a fee to ride-Southern members get in free.

SFWDA can't do it, the bylaws don't allow it.  And the liability would be a killer, just like RCRC couldn't buy land.

BRC and united have much deeper pockets than SFWDA does.  But this lawsuit will probably clean out SFWDA coffers regardless.  My understanding is that we have a good chance of winning.  USFS did not follow their own rules and abandoned the science.

Can't never could! Change the Damn by-laws. Southern could afford the best liability policy out there by speading the premium out to all members. RCRC could have bought the land but didn't want to pony up extra funds for liability insurance. This is why we all are going to lose our hobbie-we can't get together and pool our resourses. We spend thousands on our rigs and we are going to end up driving down the Parkway. Lets start a new organization that can!

I still believe this has nothing to do with TU and everything to do with a particular "agenda" within the Department of the Interior and Salazar passed down to Hilliard who is simply following orders.  I think it's a much bigger fish we're dealing with.
 
...and as far as Southern is concerned, I just don't know what to think anymore.  I don't want them to fail, but I'm just not convinced this is a winnable battle no matter how deep the pockets are that are funding it (BRC etc).
