Me and about six other friends just got our Atvs impounded tonight because the cops said we were trespassing. But the thing is, is that we did not get cought on the land but they still wrote us tickets and took every single F****** one of our Four-wheelers but i dont see how they could do that if they did not catch us, and the other thing is that i wasnt even ridding on mine cause i ran out of gas about an hour before and was ridding on the back with a friend when they cought us but they still took mine so would someone please explain to me how the cops can do that???????????????????????

So, if I understand correctly, you were trespassing, but didn't get caught while riding but they came and wrote tickets and impounded your ATV after the fact on some other, supposedly legal property. Have I got that right? Simple questions: Which state, where in that state, which Law Enforcement organization wrote the tickets and what ordinance (i.e. law) was cited on your ticket. Oh, and if you were riding illegally and trespassing, i.e. riding on land which was posted and did not have permission, what kind of sympathy did you expect from us? Al

I aint no lawyer.....but as I understand the law, you dont have to be caught red-handed in an illegal act to be cited for it. I think its called "ipso facto" - by that very fact (as in therefore...) according to wikipedia. Its like hunting deer out of season is illegal, and if you get caught with a shot deer, you will be cited even though the officer didnt see you shoot the deer. If you are riding on land that you dont have permission to ride on, you deserve to lose your ATVs and more. But you do have legal recourse, presumption of innocence etc. Get a lawyer. |

like this has gone before deputies have stated to us about those damn fourwheelers in our fields land does not have to be marked or therefore your yards would have to have signs in them to prevent me from cutting dougnuts in your front lawn- its illegal too all land is private property unless marked by government signs if you dont own it or know who does or have permission you are tresspassing if you are caught in a crop field and have done (or there has been done and you are the one caught)$2500 in damage it is a felony in alabama if a fourwheeler is caught in one of our fields we reseve the right to hold untill repayment for damage is done (per sherrif's word's) a truck can be impounded by landowner under police supervision by a wrecking company therefore if you have a fourwheeler and are caught technically you can lose it for good

Stupid Kids...I know I'm not muh to tlak but my freinds will ask permission to use land first, and even then if there is a field we won't go on the crops, usually take the 4wheelers in like the woods on the guy's land. It's a lot more interesting that way, IMO.
